These terms and conditions govern the sale of products and provision of services (“products”) to you by BestatFlooring whose address is detailed on their website; Email [email protected]; Company number 7693577 (hereafter “us” or “we” or “our”) trading as an independent retailer. Please read these terms and conditions carefully before purchasing products from us. By ordering our products, you signify your agreement to be bound by these terms and conditions. This website is owned and operated by bestatflooring.co.uk, a trading name of Jims Carpets Limited a company registered in England and Wales with registered address Unit 2 Orion Way, Leeds, LS9 0AR; Email: [email protected]; VAT number GB 411 3079 40. Unless expressly stated otherwise, the singular includes the plural and vice versa.

Forming a contract for the supply of goods

In respect of all of the products promoted through bestatflooring.co.uk and made available by us, you will contract directly with us in respect of all transactions.

Please note that when you purchase a product through this website you are paying for the flooring and ancillary products and delivery being charge to your address via our premises and not any other services. If you would like us to install your chosen flooring products please email us at our email address set out above in order to make arrangements for a fitting.

Your order represents an offer to purchase products from us. By completing and submitting an online order form you are making an offer to purchase products in accordance with these terms and conditions which, if accepted, will result in a binding contract between you and us. Note that the Acknowledgement Email is not acceptance by us of your offer to purchase products.

We must receive full payment of the price of the products before we can accept your offer to purchase products from us. Your offer to purchase products will only be accepted by us when we send an email to you advising that your order has been accepted and despatched (an “Order Confirmation”). Only at this stage is a binding contract created. It is your responsibility at this stage to ensure that all details (delivery address, product details & total costs) are correct, all costs that occur because of an error in order will be your responsibility.

We reserve the right to refuse any order prior to the issue of an Order Confirmation.

You acknowledge that any text, price lists, lists of products or other sales literature appearing on this website constitute an invitation to treat and may not be construed by you as an offer by or binding obligation upon us to provide any product.

Payment Terms

All prices and charges on this website are in UK Pounds Sterling.

All prices are unless otherwise stated, exclusive of UK VAT.

International Buyers – Please Note: Import duties, taxes, and charges are not included in the item price or shipping cost. These charges are the buyer’s responsibility. Please check with your country’s customs office to determine what these additional costs will be prior to bidding or buying.

Although we try to ensure that the prices quoted on this website are accurate, and the products have been fairly described, mistakes can occur. If, after we have accepted your order, we discover a product’s correct price is lower or higher than our stated price, or there is a material error in the description of products, we will contact you for instructions before dispatch.

At any time before you are issued with an Order Confirmation, we reserve the right to adjust prices, offers, products and descriptions of products on this website, including correction of any typographical or other errors or omissions. If we make any adjustment to price and/or description we will contact you for instructions before the Order Confirmation is sent to you.

If we cannot contact you to advise of an error/ adjustment in price and/or description, we will treat the order as being cancelled. If the order is cancelled we will refund all money taken from you relating to the purchase of the products.

Availability

All orders are subject to availability. If, before you are issued with an Order Confirmation, we discover that the products you ordered are not available, we will notify you of this and provide a refund of any money paid to us for the products unless we agree to a longer delivery period with you.

We reserve the right to withdraw any products from this website at any time before we accept your order, and we will not be liable to you, or anyone else, for withdrawing products.

Your rights of cancellation

Under the Consumer Contracts Regulations 2014 you will, if you are buying as a consumer, have up to 14 days from the day after the day on which the goods are delivered to you to cancel your purchase of the product, for any reason, provided that (i) if the product is cut or special ordered you will no longer have this right of cancellation in respect of this product; and (ii) if we start (with your consent) any of services which you have ordered before the end of this 14 day period, you will no longer have the right to cancel these services. If you wish to cancel, you must notify BestatFlooring via email of your wish to cancel your purchase of the product using the email address set out below. bestatflooring.co.uk will tell you in the Acknowledgment Email if you do not have a right to cancel.

If you are not ending the contract with good reason, then the contract will end immediately and we will refund any money you have paid for goods not received but we may deduct or charge you as compensation for the net costs we will incur as a result of your breaking the contract or reasonable compensation. If the order is cancelled after the goods have been dispatched, we will refund the money you have paid once we have received the goods back into our warehouse, however, we may deduct or charge you as compensation for the net costs we will incur as a result of your breaking the contract.

If you wish to cancel you must keep the goods in your possession and take reasonable care of them until you return them to us. Goods should be carefully repackaged and returned to us at the address provided in your Order Confirmation complete, unused and in ‘as new’ condition.

Examples of a failure to take reasonable care of goods may include if you use the goods, if you fit or part fit the goods or if you remove the goods from their packaging and fail to properly repack them.

Cancelling your order

Products which form part of a cancelled order must be returned provided it is in resalable condition, to the address provided to you by us in the Order Confirmation.

If you cancel your order and the returned goods are in the condition required by these terms, we will refund the price of the goods, less any delivery costs or charges incurred, to you within 30 days. We will not be liable for the delivery costs incurred by you for the return of the goods. If you do not return the goods within 30 days of the date of your cancellation or if you request collection then we shall be entitled to arrange to collect the goods and shall charge you up to a £200 fee for such collection. If you cancel any services, we will refund the price you have paid for the cancelled services to you within 30 days.

Collections

If you are collecting your flooring from us there are some requirements that must be adhered to for goods to be released. We provide a PDF document with every order detailing your order and the documentation you must bring. Please ensure you bring a form of ID (Passport, Driving Licence etc) and the payment card used. Please note the signature on each must match. This process is in place to ensure that we do not release goods without first confirming the cardholder is present.

For fraud prevention purposes as a company, we do not allow for third-party carriers to collect materials, unless payment is made by bank transfer and we are informed prior to collection.

Deliveries

Please note that before an order is complete we may have to contact you to confirm delivery fee’s for your order. There may be additional delivery charges applicable to your order but we will contact you to confirm these prior to the order being complete.

Deliveries are made on your requested day approximately between the hours of 8 am to 7 pm. Unfortunately, requests for an E.T.A (Estimated Time of Delivery) are at the courier’s discretion. Where possible we will advise you at the time of order of approximate delivery lead-times, exceptions may apply.

All delivery services could be made on a lorry or a van so it is assumed that the delivery address will be accessible. If there is likely to be a problem please inform us at the time of order to discuss alternative delivery options. Please ensure you inform the courier of any known restrictions that may prevent delivery – e.g. un-adopted roads, rural location, low bridges or width restrictions. The seller will not be held responsible for any delays caused by known restrictions.

If your order arrives as arranged but we’re unable to deliver because there’s nobody home, there’s inadequate help available, the goods are refused, or the order is cancelled whilst in transit (goods are in transit 24hrs before the chosen delivery date) you will be liable for any additional costs incurred for the goods being returned. The return delivery charge for failed deliveries is an £ 85.00 minimum or £ 0.70 per kg, whichever the greater.

It is important to check the packaging for any visual damage to the goods and sign for your order on arrival. If you are unfortunate enough to receive damaged goods or there are missing items, please make sure it is noted on the courier’s paperwork. We also require you to contact us directly within 24 hours to make sure we are aware of the problem. All damages should be reported within 24-hours of receipt for insurance purposes, and photographic proof should be sent to [email protected].

The delivery process ends once your goods have been signed for. Therefore we recommend you make provisions to receive the products as they will need to be moved to a safe location and if you have any problems please feel free to contact our team using the Live Chat link at the bottom of this page.

We cannot be responsible for any consequential losses, therefore we advise against booking installers until goods have been received and checked.

Standard delivery is made to the kerbside due to insurance guidelines so please arrange for adequate help to carry goods into your property. Please note that for standard deliveries, drivers are unable to dispose of packaging materials, including pallets. These are to be disposed of by the customer in an appropriate way.

Delivery charges to the UK vary by product and delivery area. Estimated delivery times can be found on the delivery tab on each product page, and delivery charges will be confirmed at checkout. However, due to the nature of our products, these may occasionally need to be altered after an order has been placed, if this is the case our sales team will be in touch with you ASAP to arrange alternate means/discuss the order further. Safe Place Deliveries.

At Best at Flooring, we understand that life gets busy and even within an allocated delivery date it can be difficult to make sure you’re in to sign for deliveries. To help you avoid missing deliveries and associated re-delivery charges, we now offer a Safe Place Delivery option on parcel orders of less than £100*.

You can choose the Safe Place Delivery option by providing details of your safe place at the time of ordering or in writing to [email protected] at least 24 hours prior to delivery.

In accordance with the Consumer rights Act 2015, when you choose the Safe Place Delivery option you will be responsible for the goods being left in accordance with your instructions so before you select this option be sure you have a good safe place. That means somewhere that’s protected from the elements, easy for delivery drivers to find and out of plain sight. Popular examples include porches, sheds, greenhouses or even dedicated Safe Parcel Delivery Boxes that are widely available to buy online.

* Safe place deliveries can be offered on parcel services only; if the products have to be sent on a pallet this service is not available. If no Safe Place is provided and no-one is home to sign for the delivery, re-delivery charges may apply.

Storage of Products

We will only keep products in our warehouse for a maximum of three months after the date of your order. This includes any part-fitted products. You must accept delivery of your products within this time. If not, you authorise us to dispose of your products with no liability on us. In the event that we agree to store your products for longer than three months, we will advise you of the charges for storage, and you agree to pay such charges in advance. Further, you accept that during the period in excess of three months, your products may be damaged and you accept full responsibility for such damage.

Calculated Prices

The calculator provided on our product pages has been designed to be as user friendly as possible and is highly accurate, there may be times where prices quoted in the calculator are not accurate due to the complex calculations being made and the number of products we are maintaining on our site; therefore we cannot be held responsible for inaccurate quotes based on this calculated price, however, we do ask that if you spot an error to advise us immediately.

Website Imagery

Please be aware all product imagery on our website is accurate to the best of our knowledge. In rare instances there may be errors in products matching the images on display, if you feel there is an error or you would like to check with us, simply call or email us.

The colour representation of the product images is not guaranteed, we always recommend ordering a sample or visiting your local floor coverings showroom to see the product for yourself.

Carpet Specific Conditions of Sale

When ordering from BestatFlooring via the website or over the phone you have a right to cancel and return your order up to 14 days after receiving your order. Some products like Carpets & Lino (Vinyl Rolls) are excluded from this policy as they are cut to your bespoke size. Please note you will be responsible for the organisation and cost of returning the item(s) to us. All items must be returned in the same packaging and condition in which they were received by you.

In the unlikely event that you receive faulty or damaged goods, please contact us prior to cutting and/or fitting the item(s) and we will arrange for the faulty or damaged goods to be collected and replaced. Unfortunately, if any ordered item is removed from its original condition (for example cut and fitted) we will be unable to replace or give a full refund for the item(s).

When you receive your order, please remove all packaging and thoroughly check the ordered item(s) before booking your flooring fitter to ensure it is the correct quality, size, pattern and colour as you expected, and free from damage and/or defects. Once you have cut into and/or fitted the item, you are the owner and bestatflooring.co.uk cannot be held responsible for any exchanges or fitting costs.

Packaging and the product itself can include staples or sharp objects. Please ensure that you or your fitter have checked the product thoroughly for such items and removed all such packaging with care before securing the item(s) for everyday usage. Online Carpets cannot be held liable for any injuries incurred by anyone where the item(s) purchased have been installed without being thoroughly checked for sharp objects prior to or during the installation process.

Please note, we are unable to guarantee an exact colour match on different rolls. If an exact colour match is required please contact us at the time of ordering and we will do all that we can to help. An exact colour match is especially hard to achieve when different widths have been used, or the flooring has been ordered on different dates.

All pile carpets, especially plain grounds are liable (after they have been in use for some time) to shading, i.e. to show light and dark patched areas. This is due to the uneven pressing of the surface by treading. Light and delicately shaded carpets are liable to become soiled with wear and it may appear that the colours have faded. Both tendencies are inherent in all pile fabrics and therefore we cannot accept any responsibility for complaints arising from either of these causes.

All dimensions are in accordance with British Standards 3655 (1974) +/- 1.25% in width and/or length.

Other terms and conditions

BestatFlooring Ltd ensure that the best effort is made to ensure the information on our website is accurate and we reserve the right to refuse the sale of products mis-priced or misdescribed. Human error does occur and if this is the case we will do our best to resolve the problem and refund your money as soon as we can. We are unable to guarantee colour or pattern matching and we strongly suggest you view a product in person prior to ordering. You may contact us for product samples. Pictures are for guidance only and we cannot be responsible for shade/colour matching to the existing flooring. For carpets from different size widths, we cannot guarantee an exact match.

We have no responsibility for products once they have been installed, where faulty installation and/or poor workmanship is at fault. Part orders cannot be sent back. Claims for mismatching or wear and tear damage cannot be made after fitting. We accept no responsibility for third party fitting problems.

The Company reserves the right to change these terms and conditions at any time without prior notice. In the event that any changes are made, the revised terms and conditions shall be posted on this website immediately.

Limitation of liability

We shall not be liable to you (except in respect of injury or death of any person resulting from our negligence) regardless of the form of action, whether in contract, tort (including negligence and breach of statutory duty), strict liability, or otherwise, for any loss of profit, business, contracts or revenues, or for any special, indirect or consequential damage of any nature whatsoever arising directly or indirectly out of your use of our website.

Ownership and title

All ownership, title and risk of loss and/or damage in the products you have purchased shall pass to you at the point in time at which such product leaves our premises.

Notices

All notices given by us to you will be sent by e-mail from our email address set out above.

Waiver

No waiver by us of any breach of these terms and conditions shall be considered as a waiver of any subsequent breach of the same or any other provision.

Invalidity

If any provision of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions (and the remainder of the provision in question) shall be unaffected.

Governing Law

The interpretation, construction, effect and enforceability of this agreement shall be governed by English Law, and you and we agree to submit to the exclusive jurisdiction of the English courts for the determination of disputes.
